Privacy, security and data protection are at the heart of how the 2 Minutes Max Platform operates.
Your email address is never disclosed to a Candidate, an Organization or any third party.
It is used exclusively to authenticate your account, secure access to the Platform and ensure the proper operation of the services provided by 2 Minutes Max, in accordance with our Privacy Policy.
Professionals do not have access to a candidate database. They may only view 2’MAX Profiles that have been voluntarily shared with them or to which they have been granted access as part of the services provided through the Platform.
Each User remains in control of the information they choose to share. The services offered by 2 Minutes Max are designed to promote secure, confidential and privacy-conscious interactions.
1. Scope and Acceptance
These General Terms of Sale and Use (hereinafter the “GTSU”) govern the conditions for accessing and using the website www.2minutesmax.com (hereinafter the “Website”), the application available at https://app.2minmax.com (hereinafter the “Application”), and all services provided by 2 MIN MAX (hereinafter “2 MIN MAX” or the “Company”).
These GTSU apply to any person using the Website or the Application, including in particular:
- visitors;
- Candidates;
- Professionals;
Any use of the Website or the Application constitutes full and unconditional acceptance of these GTSU.
2 MIN MAX reserves the right to amend these GTSU in order to reflect changes to the Platform, the services offered or the applicable legal and regulatory framework.
Where substantial changes are made, Users will be informed by any appropriate means. Continued use of the Platform after the revised GTSU come into effect shall constitute acceptance of the updated terms, subject to any mandatory provisions of applicable law.
2. Definitions
For the purposes of these GTSU, the following terms shall have the meanings set out below:
Application: the application published by 2 MIN MAX, accessible in particular at https://app.2minmax.com.
Website: the website available at www.2minutesmax.com.
Platform: the Website, the Application and all digital services provided by 2 MIN MAX.
User: any person using the Platform, whether or not they have created an account.
Candidate Account: a personal account enabling an individual to create, manage, share, deactivate, reactivate or permanently delete one or more 2’MAX Profiles, depending on the subscribed Offer.
Candidate: any individual holding a Candidate Account for the purpose of creating and sharing one or more 2’MAX Profiles as part of a job search, apprenticeship, internship, assignment, admission process, call for projects, competition or any other project requiring a video presentation.
Professional Account: an account intended exclusively for professional use. Its activation may be subject to verification procedures designed to confirm the applicant’s professional status.
Professional: any individual holding a Professional Account and using the Platform in the course of their professional activity.
Organization: any legal entity (including companies, public authorities, educational institutions, training providers, recruitment agencies, associations or any other organization) using the services provided by 2 MIN MAX.
2’MAX: a video presentation with a maximum duration of two minutes, created by a Candidate or, depending on the features available on the Platform, by an Organization.
2’MAX Profile: a 2’MAX together with all information associated with it on the Platform, including its title, the elements required for sharing it, and any applicable features and statistics.
Premium: an Offer intended for Candidates providing access to additional features.
Sponsored Premium: Premium access funded by an Organization for the benefit of a Candidate, under the conditions offered through the Platform.
PRO: an Offer intended for Organizations providing access to advanced professional features.
PRO+: an Offer intended for Organizations providing access to additional features, including management, monitoring, support and analytics tools.
Subscription: an agreement granting access to one or more Offers provided by 2 MIN MAX.
3. Operation of the Platform
3.1 Candidate Accounts
Creating a Candidate Account provides access to the features offered by 2 Minutes Max, depending on the selected Offer.
Candidates may, in particular:
- create one or more 2’MAX Profiles;
- record, edit or replace their videos;
- complete or update the information associated with their profiles;
- share their 2’MAX Profiles using the methods made available through the Platform;
- deactivate or reactivate a 2’MAX Profile;
- permanently delete a 2’MAX Profile or their Candidate Account.
Candidates remain solely responsible for the information, documents and content they publish on the Platform.
3.2 Professional Accounts
Professional Accounts are reserved exclusively for individuals using the Platform in the course of their professional activities.
2 MIN MAX may carry out any verification it considers necessary to confirm the applicant’s professional status before activating a Professional Account.
The Company reserves the right to refuse or deactivate a Professional Account where the eligibility requirements are not met or where the services are used in a manner that does not comply with these GTSU.
Professionals may only view 2’MAX Profiles that have been voluntarily shared with them or to which they have been granted access through the features provided by the Platform.
Professionals do not, at any time, have access to a candidate database.
3.3 Available Offers
2 Minutes Max provides a range of Offers for Candidates and Organizations.
The features available depend on the subscribed Offer and are presented on the Website or during the subscription process.
The Company may modify the content of its Offers in order to improve the services provided, provided that such changes do not affect the contractual commitments applicable to existing Subscriptions.
3.4 Sharing and Viewing 2’MAX Profiles
2’MAX Profiles are intended to be viewed only by the persons to whom the Candidate or the Organization chooses to make them available, in accordance with the conditions provided by the Platform.
The methods for accessing and viewing 2’MAX Profiles may evolve in order to improve security, user experience or the operation of the services.
Viewing a 2’MAX Profile may result in the recording of technical or statistical information necessary for the operation of the Platform, access security, the production of usage statistics or the improvement of the services, in accordance with the Privacy Policy.
3.5 Changes to the Platform
2 MIN MAX continuously develops new features to improve the Platform.
Features may be added, modified, replaced or discontinued, including as part of the various Offers provided by the Company, provided that this does not affect rights already acquired under existing Subscriptions, unless otherwise required by law or by contractual obligations.
4. Personal Data
2 MIN MAX attaches particular importance to the protection of its Users’ personal data.
Personal data are collected and processed in compliance with the applicable legal framework, in particular Regulation (EU) 2016/679 of 27 April 2016 (GDPR) and the applicable French legislation.
The purposes of the processing operations, the categories of data collected, the retention periods, the recipients of the data and the rights of data subjects are described in the Privacy Policy of 2 MIN MAX, which is available at all times on the Website and the Platform.
Each User undertakes to provide accurate, complete and up-to-date information when creating an account and when using the services.
5. Offers, Subscriptions and Billing
2 MIN MAX provides both free services and paid Offers for Candidates and Organizations.
The characteristics, features, pricing and conditions applicable to each Offer are presented on the Website or during the subscription process.
Subscriptions are entered into for the period specified at the time of subscription and are renewed in accordance with the terms communicated during the ordering process, unless terminated under the applicable conditions.
Payments shall be made using the payment solutions offered by 2 MIN MAX.
In the event of non-payment, 2 MIN MAX may suspend or restrict access to the relevant services until the outstanding amounts have been settled.
Prices may be amended for future Subscriptions or upon renewal of an existing Subscription, provided that the User is informed within a reasonable period in advance.
6. Liability
Each User is responsible for their use of the Platform and for any information, documents, videos or other content that they publish or share.
Users warrant that the content they make available does not infringe the rights of third parties, complies with applicable laws and regulations, and does not contain any unlawful, defamatory, abusive, discriminatory, fraudulent or privacy-infringing material.
Candidates remain solely responsible for the information contained in their 2’MAX Profile(s).
Professionals remain solely responsible for the use they make of the information viewed on the Platform.
2 MIN MAX acts as the publisher of the Platform and as the hosting provider for content published by Users. The Company does not intervene in the relationships between Candidates, Professionals and Organizations and shall not be held liable for any decisions taken by Users as a result of using the services provided through the Platform.
2 MIN MAX implements reasonable measures to ensure the availability, security and proper functioning of the Platform. However, the Company does not guarantee uninterrupted availability and shall not be held liable for temporary service interruptions, maintenance operations, technical incidents or events beyond its reasonable control.
7. Suspension, Restriction and Deletion of Accounts
2 MIN MAX may suspend, restrict or terminate all or part of a User’s access to the Platform where the User:
- fails to comply with these GTSU;
- uses the Platform fraudulently, abusively or for purposes inconsistent with its intended purpose;
- infringes the rights of third parties or disrupts the proper functioning of the services;
- provides information that is manifestly inaccurate when creating or using an account.
Where circumstances permit, 2 MIN MAX will inform the User in advance and allow them a reasonable opportunity to submit observations or remedy the situation.
In cases of serious misconduct, fraud, identity theft, threats to the security of the Platform or where required by law, the suspension or deletion of an account may take effect immediately and without prior notice.
Users may delete their account at any time using the procedures provided by the Platform. Such deletion shall not affect any legal or contractual obligations that continue to apply, including obligations relating to billing or the retention of certain data where required by law.
8. Intellectual Property
The Platform, the Website, the Application, their architecture, software developments, databases, visual identity, texts, logos, trademarks, illustrations and, more generally, all elements protected by intellectual property rights are the exclusive property of 2 MIN MAX or are used under valid licence.
Any reproduction, representation, distribution, extraction, adaptation or exploitation, in whole or in part, without the prior written authorization of 2 MIN MAX is prohibited.
Videos, documents, texts, images and other content published by Users remain their property.
By publishing content on the Platform, the User grants 2 MIN MAX a non-exclusive, worldwide, royalty-free licence, limited to the period during which the content is made available and strictly necessary for the hosting, storage, distribution, security and operation of the services provided.
This licence automatically terminates upon the permanent deletion of the relevant content, subject to any legal data retention obligations.
9. Governing Law and Dispute Resolution
These GTSU shall be governed by and construed in accordance with French law.
In the event of any dispute concerning their interpretation, performance or validity, the parties shall first seek an amicable resolution.
Failing an amicable settlement, the dispute shall be submitted to the competent French courts, subject to any mandatory legal provisions applicable to consumers.
10. Miscellaneous Provisions
The failure of 2 MIN MAX to enforce any provision of these GTSU at any time shall not be construed as a waiver of its right to enforce that provision at a later date.
Should any provision of these GTSU be held to be invalid, unlawful or unenforceable, the remaining provisions shall remain in full force and effect.
These GTSU constitute the entire agreement between 2 MIN MAX and the User regarding the use of the Platform and supersede any previous version relating to the same subject matter.
