SCOPE OF THE T&Cs

1-1 ACCEPTANCE

Access to and use of the website available at the following address:

https://www.2minutesmax.com/ (hereinafter referred to as the “Site”) provided by the company 2 MIN MAX (hereinafter referred to as the “Site Owner”), as well as the services offered therein, are governed by these General Terms and Conditions of Sale and Use (T&Cs). These conditions detail the terms of use of the Site, order placement, payment, and provision of Services ordered by Clients.

The T&Cs also govern the use of the application made available by 2 MINUTES MAX by any user (the “User” or “you”), whether they are:

• An internet user accessing, visiting, and browsing the Site;
• An internet user registering, creating an account, and accessing their account on the Application.

By browsing the Application and performing actions within it, the User acknowledges having read these T&Cs and accepts them without reservation.

The T&Cs are regularly updated to improve the functionality of the application and the features offered. Thus, 2 MINUTES MAX reserves the right to modify these T&Cs at any time and recommends checking them regularly. Users will be informed of subsequent versions containing substantial modifications to the T&Cs for acceptance.

The applicable T&Cs are those in effect at the time of the User’s access.

2 MINUTES MAX reserves the right to terminate the User’s use of the Application or delete their user account for any conduct violating these T&Cs.

These T&Cs are supplemented by the Privacy Policy, which is an integral part of the provisions governing the relationship between 2 MINUTES MAX and you.

DEFINITIONS

• Application: Refers to the application developed by 2 MIN MAX, available at app.2minmax.com.
• Site: Refers to the official 2 MINUTES MAX website, accessible via the URL: https://www.2minutesmax.com/.
• Candidate: Refers to an individual registering on the application by creating a user account and publishing their profile.
• Recruiter: Refers to an individual or legal entity, represented by their legal representative or any authorized person, who creates a user account on the application and accesses candidate profiles via the URL link or corresponding QR code.
• User: A person who has created a user account and navigates the application. This can be a Candidate or a Recruiter.

APPLICATION OVERVIEW

3.1 Purpose of the Application

The Application aims to facilitate connections between Recruiters and Candidates.

The Application is exclusively intended for candidates seeking employment or freelance missions and for companies looking to recruit or engage a service provider. Its use is strictly limited to these purposes, and it is prohibited to reuse content published in the application for other purposes.

3.2 Access and Functioning of the Application

Access to the Application: The User is responsible for setting up the necessary IT and telecommunications resources to access the Application, as well as their competency in using the Internet.

The User is also responsible for internet connection fees and the equipment required to use the application.

The User uses the application at their own risk.

It is strictly forbidden to attempt to gain unauthorized access to the service, to access the Application, or to maintain access by means other than the interface provided by 2 MINUTES MAX for this purpose.

User Account/Subscription: Creating an account is essential to access the functionalities of the Application and update personal information.

Users can create an account directly on the application by providing the required information.

User Responsibilities: The User is responsible for using the Services by authorized Users and ensuring their compliance with these Conditions. Creating a user account is reserved for persons over 15 years old or the applicable digital consent age, whichever is higher.

The User must ensure that the information they provide is accurate, up-to-date, and does not infringe on third-party rights.

2 MINUTES MAX does not have the technical means to verify Users’ identities and cannot guarantee their authenticity. However, if there is any doubt about the accuracy of information provided by a User, 2 MINUTES MAX reserves the right to request official proof of identity and/or suspend account access during necessary verifications. If the User fails to provide the requested documents or if the data is proven to be inaccurate, registration may be refused, or the account may be suspended.

Account login credentials, particularly the password, are personal and confidential. The User is solely responsible for their use, and any login to their account will be presumed to have been made by them. In case of loss or theft of the password, or suspected loss or theft, the User must immediately generate a new password by clicking on “Forgot Password” in the “Login” section.

PAYMENT

2 MINUTES MAX offers a free service for candidates and a paid service for recruiters, with different plans based on the number of desired licenses.

Subscription fees are exclusive of tax unless otherwise stated in an agreement with 2 MIN MAX, in the Service, or on an applicable invoice. Tax rates are calculated based on the billing information provided and the applicable tax rate at the time of subscription billing.

Users may stop using the Service and/or terminate their subscription at any time via their account settings. If you cancel your subscription, you will not be entitled to a refund of fees already paid, and all unpaid fees will become immediately due and payable.

2 MINUTES MAX may offer a free trial or pilot program to allow you to try our Service. 2 MINUTES MAX reserves the right to set eligibility conditions for free trials and pilot programs as well as their duration.

LIABILITY

4.1 User Responsibility

The User agrees to use the Application and their user account responsibly and lawfully.

The User is prohibited from:

• Creating a profile in the name or on behalf of another person;
• Publishing a profile solely for the purpose of promoting products or services or diverting the application’s purpose;
• Uploading or displaying unauthorized, illegal, or harmful content;
• Processing personal data on the Application in a manner not compliant with applicable regulations;
• Disrupting or interrupting the Application’s operation;
• Using data mining, bots, or similar automated methods to collect and/or exploit data from the Application;
• Impersonating another person;
• Accessing data not intended for them or unauthorized accounts;
• Removing or modifying another person’s published content;
• Harassing another User.

Although 2 MINUTES MAX is not responsible for videos published on the Application, it reserves the right to remove any video that does not comply with these T&Cs or could harm 2 MINUTES MAX or third parties, including Candidates.

PERSONAL DATA

2 MINUTES MAX collects only the necessary data for platform use: user email addresses, job profiles, and phone numbers for recruiters.

Videos recorded on candidate profiles are hosted in France on a dedicated server. They are encrypted and accessible only by the User or designated recipients subscribed to 2 MINUTES MAX.

Users have rights regarding access, rectification, deletion, and data portability. These rights can be exercised directly via their personal account.

GOVERNING LAW

These T&Cs are governed by French law.
